Boundary and Easement Issues
Neighbors find that they have disputes concerning boundaries and easements. One owner may be installing a fence over the neighbor’s property line, thereby enlarging the size of one owner’s front yard at the expense of the neighbor. 

In another case, a property owner may have an easement for access across a neighbor’s property in order to access the beach, but the neighboring property owner installs a fence preventing the neighbors from using their easement. 

These are the types of boundary and easement disputes that we handle.

Architectural Approval
There are circumstances where one neighbor wishes to remodel his house from a one story house to a two story house. The next door neighbor who has a one story house is concerned about privacy and view impairment. This issue calls for a balancing of one neighbor’s right to remodel his house against the other neighbor’s right to privacy and view.

Interpretation of CC&R’s and Bylaws
There are many circumstances in which the Board of Directors, or its management company, may interpret the CC&R’s differently than a property owner. When the CC&R’s state that views have to be considered when the Association reviews architectural applications for home remodeling, does this mean that there can be no view impairment at all, or no substantial view impairment, or that the relative views of the affected neighbors have to be balanced, or that views are one of several factors that have to be considered.
